Can you sell homestuck merchandise




















Some time circa June , Viz Media and Redbubble entered into one of these fan art partnerships. After that, Viz went through that queue and approved — from what I can tell — almost everything. If you were a RB Homestuck artist before, you got a notification that your art was claimed by Viz and was temporarily suspended , and a few weeks later you got a notification that it was approved and back up for sale.

Viz had asserted that it was the rights owner of Homestuck, and therefore the rights holder of the subject of your work. Anything they claimed to own, you were now selling at their pleasure, not your own. And thus solves the mystery of how Viz got the right to demand you stop quoting Eddie Morton. Redbubble handed the rights to Viz on a silver platter.

Once the agreement ended, Viz exercised its right to eradicate the design. All this far exceeds what copyright law requires. One thing about all this that stands out to me particularly is: why Viz? Viz Media keeps claiming to be the rights holder here, but is that even right? Viz media owns a limited subset of publication rights for producing and marketing the physical hardcover collection and the epilogues.

So… did Viz even have the IP rights it claimed to in ? Take a look at those official merchandise websites. Those represent all the merchandise we as consumers are able to procure. Maybe Hussie could merely ask that people who make fan merchandise paypal him a certain cut for royalties on the sale? Is what these artists do really any different? Our goal is to raise awareness of this issue in the hopes that maybe someday Andrew Hussie will allow us to share our love of Homestuck in unofficial ways.

And keep in mind that all the works of art on this website were created without the desire for monetary gain in the picture. Imagine what sorts of things we might see from artists with that extra incentive. A : Yes, under certain specific conditions. First of all, the "commissions" we refer to here are only unique, two-dimensional images.

If you want to sell, on a commission basis, your two-dimensional art with Andrew's intellectual property in it, that's fine, as long as a neither you nor your commissioner or any third party have any plans to reproduce, resell or make a profit off of the commissioned image and b you do not promote yourself as a Homestuck artist.

This means you would be creating single, unique images for a single commissioner who would not be using that image for any monetary or commercial reason. If you're all right with those conditions, go for it! Q: What about different kinds of commissions plushes, etc? A: Those are pretty much all no-gos. We don't allow any sales of Homestuck items. Q: But what about conventions? A: Sorry, all the same rules apply at conventions; please don't sell Homestuck items there!

Q: What about cosplay items? A: Sales of cosplay items fall into "different kinds of commissions," above. It's true that we don't sell full costumes, but we do not allow their sale by third parties, either. Ultimately a cosplay costume is something that is so broad and can encompass so many items many of which we are either selling or planning to sell that the best move for us, legally, is to simply not allow any sales of any of those kinds of items.
